On February 19, 2026, the Georgia State Elections Board voted to issue a formal letter of reprimand to Elon Musk's America PAC for violating Georgia election law during the 2024 presidential campaign. The investigation found that America PAC sent partially prefilled absentee ballot applications to voters across multiple Georgia counties, violating O.C.G.A. 21-2-381, which prohibits any person or entity other than an authorized relative from sending a voter an absentee ballot application prefilled with their personal information. The PAC also failed to include legally required disclaimers stating the mailings were not official government publications.
The Georgia Secretary of State's office launched the investigation in October 2024 after receiving complaints from voters in Chattooga, Cherokee, Coweta, Floyd, and Whitfield counties who had received the prefilled applications. A police report was filed in January, and security camera footage documented at least one incident.
The irony is staggering. Donald Trump spent years claiming the 2024 election was stolen in Georgia. He pressured Georgia officials to “find” votes. He and Musk railed endlessly about election integrity and voter fraud. And all along, Musk's own political operation was the one actually breaking Georgia election law to help Trump win. The man Trump put in charge of government efficiency was running an illegal ballot operation in the very state Trump claimed was rigged against him.
The punishment — a letter of reprimand — is widely seen as a slap on the wrist for a billionaire who spent over $250 million to elect Trump. Critics noted that ordinary citizens face criminal prosecution for far less serious election violations.
